Nola Calendar Terms of Use

These Terms govern your use of the Nola Calendar app and service for iOS and macOS.
Developer and service operator: Chirkov Nikita Sergeevich (Чирков Никита Сергеевич), an individual developer, located in Moscow, Russia, email: contact.tech.company@gmail.com.
The license for an app downloaded from the App Store is also governed by Apple's Standard Licensed Application End User License Agreement. If mandatory law or Apple's standard EULA gives you greater rights, those rights apply.
1. Acceptance
By using Nola Calendar or accepting these Terms in the app, you agree to these Terms and the Privacy Policy. If you do not agree, do not create an account or use the app's cloud features.
If you are not old enough to accept these Terms under the law where you live, a parent or legal guardian must act for you.
2. Purpose of the app
Nola Calendar helps you create calendar events, schedules, shifts, classes, meetings, reminders, and plans and synchronize them between your devices.
The app is a planning tool. It does not provide medical, legal, financial, or other professional advice and does not guarantee any particular outcome.
3. Account and iCloud
Account and synchronization features use Sign in with Apple and the active iCloud account. You are responsible for keeping your Apple Account and devices secure and for maintaining appropriate system settings.
Data belonging to different accounts is kept separate. When you sign out, the previous account's data is hidden. When another user signs in, the app loads data belonging to that account.
You must not access another person's data, circumvent app restrictions, or use another person's account without permission.
4. Your content
You retain your rights in events, notes, plans, and other content you create. You grant the Operator a limited right to process that content only as technically necessary to operate the app, synchronize and back up content, protect the service, and fulfill your requests.
You are responsible for the legality of your content and links. You must not use the app to store or distribute unlawful material, malicious code, or third-party personal data without a lawful basis.
You enter online-meeting links yourself. The Operator is not responsible for the content, availability, or security of third-party websites opened through those links.
5. Notifications
With your permission, the app may send event reminders and messages about important changes, security, new features, and the operation of Nola Calendar.
You can disable notifications in iOS or macOS system settings. Service notifications and advertising messages are treated separately. If marketing messages are introduced, consent will be requested where required by law.
We try to deliver reminders on time but cannot guarantee delivery at a particular moment. Delivery depends on the device, internet connection, Focus mode, system settings, and Apple services. Do not rely on the app as the only way to receive a critical notification.
6. Free and future paid features
At the date of these Terms, Nola Calendar offers no paid subscriptions. The Operator may later introduce one-time purchases, paid features, or automatically renewing subscriptions.
Before purchase, the app will show the price, currency, subscription period, included features, and automatic-renewal terms. Apple processes payments through the App Store and your Apple Account.
Unless the purchase screen says otherwise:
- a subscription renews automatically for the same period;
- Apple charges the payment method according to the timing shown at purchase;
- you can cancel in Apple's subscription settings;
- deleting the app or your Nola Calendar account does not by itself cancel a subscription;
- Apple handles refund requests, subject to mandatory consumer rights.
New prices and paid features do not retroactively reduce rights you already purchased. Mandatory warranties and consumer rights apply regardless of these Terms.
7. Possible advertising
At the date of these Terms, Nola Calendar contains no advertising. The app may later display the Operator's own offers or partner advertising. Before third-party advertising is enabled, the Operator will update the Privacy Policy and App Store disclosures and obtain required permissions.
Without separate permission where required, your data will not be used for cross-app or cross-website tracking or disclosed to data brokers.
8. License and intellectual property
You receive a limited, personal, non-exclusive, non-transferable license to use the app on Apple devices in accordance with App Store rules.
The Nola Calendar name, interface, illustrations, characters, text, software, and other app elements belong to the Operator or are lawfully licensed. You may not copy, sell, rent, modify, reverse engineer, or distribute the app except where the law expressly permits it.
9. Updates and service changes
The Operator may release updates, fix errors, change the design, and add or discontinue features. Material changes affecting your rights, fees, or data processing will be disclosed in advance where required by law.
Some functions may require a current app or operating-system version for security and compatibility.
10. Availability and backups
We aim to provide a reliable service, but it may be temporarily unavailable because of maintenance, errors, internet conditions, Apple or Cloudflare restrictions, or events outside the Operator's reasonable control.
Keep independent copies of information whose loss could cause serious harm. The Operator does not promise indefinite data retention, and the app is not a substitute for a professional backup system.
Nothing in this section excludes liability that cannot lawfully be excluded.
11. Suspension
Access may be restricted if you violate the law or another person's rights, interfere with the service, create a security risk, or abuse the app. Where reasonable and permitted, you will have an opportunity to remedy the issue.
12. Signing out and account deletion
You can sign out, delete calendar data, or initiate complete account deletion from the app's settings. Complete deletion removes associated Nola Calendar data and push registration, except information that must be retained by law.
Account deletion is irreversible after the request is completed. Your Apple Account and iCloud data can also be managed through Apple's controls.
13. Liability
The app is provided as available. To the maximum extent permitted by law, the Operator is not liable for indirect loss, lost profits, user decisions, missed events, or failures of third-party services.
These limitations do not apply to intentional misconduct or gross negligence and do not waive consumer rights that cannot be limited by contract.
14. Privacy
Data processing is described in the Nola Calendar Privacy Policy. The Privacy Policy is a separate document and is not replaced by these Terms.
15. Changes to the Terms
An updated version will show a new version date. If a change is material, the app will notify you and request acceptance where required by law. Purchase terms will not be changed retroactively.
16. Governing law and disputes
These Terms are governed by the law of the Operator's location unless mandatory law in your country requires otherwise. Before filing a claim, the parties will try to resolve the issue by email, without limiting your right to contact a regulator or court.
